Seven Towns Ltd, Rubiks Brand Limited and Professor Erno Rubik would like to make the following points in response to the Advocat General’s (AG) opinion release today, 25th May 2016 concerning the 3D uncoloured registered “3x3x3 Cube grid” trademark. 1. 1. The appeal by Simba against the judgement which upheld the registration was unsuccessful. The Judgement by the European General Court upheld the trademark on 25th November 2014 and therefore the trademark is still valid until found otherwise by the European Court of Justice (ECJ). As yet there is no date set for the judgement of the ECJ. There may still be grounds for a further appeal whatever that judgement.

2. Whilst the European Court of Justice tends to follow the Advocat General’s opinion, this particular case is likely to be a landmark ruling and therefore one cannot read too much into this prevalence. In other words this is at the moment only informed speculation.

3. Even if this particular TM is held to be invalid there are still copyright, passing off, unfair trade, and further unchallenged trademarks to rely on and the Rubik’s brand can still put up a credible fight against infringers.

Furthermore, the opinion of the AG relied upon the assumption that the shape of the cube and grid structure are necessary to perform the technical function of the puzzle and as such could not therefore form a trademark. Technically and logically what the Advocat General has said is incorrect. Please see the two puzzles below which function IDENTICALLY to the Rubiks’ Cube but which would not infringe the registered 3D Cube trademark, and also a facsimile of the trademark which we market but which has no function as a puzzle (only as a stress reliever)!!

This seems to be another example of European legislation working against the interests of European companies trying to bring new products to market and derive income from innovation. This case was first brought in 2006 and it has taken more than 10 years and there is still no definitive ruling on whether the registered trademark is valid. More importantly, an original EU (Hungarian) invention, marketed by a European company (based in the UK) whose fantastic commercial success benefits the EU could potentially be somewhat undermined by an erroneous or misinformed opinion. Beyond Rubik’s Cube Exhibition

Only a few days to go and the Beyond Rubik’s Cube exhibition will kick off at the Liberty Science Center in New Jersey.  It seems it was only  yesterday that we first announced the large-scale Rubik’s exhibition, organized for the cubes 40th anniversary.

In celebration of the upcoming exhibition,  the Liberty Science Center takes us behind the scenes to reveal one item everyday that will be displayed in the traveling Rubik’s museum.

Diamond Rubik’s Cube

Today we share a picture of  the diamond Rubik’s cube which was created by Fred Cuellar of Diamond Cutters International for the cubes 15th anniversary. The Masterpiece Cube was crafted from diamonds, ruby, emerald, amethyst, sapphire and 18 karate yellow gold.

The cube was introduced to the world in 1995 , but has never been publicly displayed as of yet. During the next seven years however, this one of a kind cube will be traveling the world for all eyes to see.

Rubik’s cube World Championship Live from Las Vegas

In only a few hours the Rubik’s Cube World Championship will kick off in Las Vegas! This is the first time the Rubik’s Cube World Championship returns to America since 2005, where more than 570 speedcubers from 39 countries will attempt to become the fastest cuber on the planet in the Sin City. This year once again, you can tune in to watch the tournament LIVE from the comfort of your home and cheer for our Canadian Rubik’s Cube team.

Can anyone beat Mats Valk’s shocking 5:55 second world record?

The race will start today, July 26 and will run until Sunday, July 28. The 2011 World Cahmpion, Michal Pleskowicz from Poland will be there to defend his title. He stole the crown two years ago with completing the 3×3 Rubik’s cube in 8.65 seconds in Bangkok. All eyes, however, are on the 17-year-old Mats Valk from Holland who beat Australian Feliks Zemdeg’s unbelievable 5.66 second time this year at the Zonhoven Open.  Of course, Feliks will be there too, so this year’s World Cup promises tremendous excitement for racers and spectators as well.

Google, the Internet giant, will become “Beyond Rubik‘s cube” online senior creative partner. Just over a year ago we reported on the latest undertaking of the Rubik’s Brand.   For the Rubik’s cubes 40th anniversary a museum exhibition will be launched traveling worldwide launching  in New Jersey at the Liberty Science Center in the spring of 2014.


“Google’s team will extend the exhibition into the digital realm, personalizing the experiences and embedding the exhibition in global social media,” according to a description of the exhibit (PDF). The Rubik’s cube and Google’s  unabashed nerdiness we think is a great match.

Word of the project trickled out on Google+ on Rubik’s 69th birthday on Saturday and as an added bonus Rubik himself joined Google+.
